Nova Terms of Use

Welcome to Nova. By accessing or using the Nova platform, tools, APIs, documentation, or other offerings (collectively, the “Platform”), you agree to be legally bound by these Terms of Use (the “Terms”) and to use the Platform in a manner consistent with Nova’s mission to support respectful, clear, and ethical human communication. If you do not agree with these Terms, do not use the Platform.

1. Registration and Access

You must be at least 18 years old to use the Platform. By registering, you affirm you have the legal authority to enter into these Terms on your own behalf or on behalf of an entity you represent.

Your access credentials—including API keys, passwords, and other identifiers—are for your personal or organization’s use only, and must be kept secure and confidential.

2. Use of the Platform

Nova grants you a limited, personal, non-exclusive, revocable license to access and use the Platform according to these Terms, any applicable policies (including our Privacy Policy), and any documentation provided by Nova.

You may use the Platform to develop, test, operate, and support your own applications that incorporate Nova services, so long as your use complies with all Terms and applicable laws.

3. Acceptable Use

You agree to use the Platform only for lawful purposes and in ways that align with Nova’s Ethical Guidelines. You may not use the Platform to:

  • Violate any law, regulation, or third-party rights.
  • Create content that is abusive, harassing, discriminatory, or harmful.
  • Interfere with the security or integrity of the Platform.
  • Attempt to reverse engineer, modify, or extract the Platform’s proprietary technology.
  • Distribute access credentials or otherwise provide third parties with unauthorized access.

You remain responsible for how you and your users interact with Nova’s services.

4. Commercial Use

Use of the Platform may be subject to subscription or licensing terms. Free access tiers are limited to non-commercial use unless otherwise stated. Paid plans enable commercial use under the pricing terms outlined on novacommunicate.com/pricing.

5. User Content

“User Content” means the data, text, audio, or other content you submit to the Platform. You retain ownership of your User Content. You grant Nova a worldwide, royalty-free license to use your User Content as necessary to provide, improve, and maintain the Platform, and to develop new features.

You represent and warrant that you have all rights necessary to provide this license, and that your User Content does not violate any laws or third-party rights.

6. Confidentiality

Certain information made available through Nova is confidential. You agree to protect confidential information and not disclose it to third parties without Nova’s written consent.

7. Security

You must implement reasonable protections to secure credentials, API keys, and any user data you collect in connection with your use of the Platform. You agree not to interfere with or circumvent Nova’s security measures.

8. Privacy

Your use of the Platform is governed by Nova’s Privacy Policy, located at novacommunicate.com/privacy. You must comply with all applicable privacy laws, including providing your own privacy terms to your users if you integrate Nova into applications that collect personal data.

9. Data

Nova does not claim ownership of your data or intellectual property you submit. However, Nova may retain, analyze, and use data in aggregated or anonymized form as permitted by our privacy practices, always aiming to improve communication intelligence responsibly.

10. Branding

You may not use Nova’s name, trademarks, or logos without prior written consent. All goodwill generated from such use inures solely to Nova.

14. Limitation of Liability

To the maximum extent permitted by law, Nova’s liability for any claim arising from your use of the Platform is limited to direct damages not exceeding the total fees you paid in the prior 12 months. Nova is not liable for indirect, incidental, consequential, or punitive damages.

15. Governing Law

These Terms are governed by the laws applicable to our legal entity’s principal place of business, without regard to choice-of-law principles.

16. Changes to These Terms

Nova may modify these Terms at any time. Revised Terms will be posted on novacommunicate.com/terms-of-use with an updated effective date. Continued use after changes signifies your acceptance.
